Yes, but these are not the same TOS. At the time of accepting the TOS of a service it also matters what the terms are, who controls the service, and often, where they are. The MiSTer forum's terms do not include a clause like this:
"...disputes that are not subject to arbitration will be resolved exclusively in the state or federal courts in San Francisco County, California, and you and Discord both consent to venue and personal jurisdiction in these courts". Being in Spain, that's a problem for me. Not that I plan to have any such dispute, but accidents happen. There's a reason why legal insurance exists, and I don't have one.
So, I'd say it's much more relevant to mention that Discord is not actually open to everyone, but only to those willing to register, than to say the same thing of the forum, even though many people still prefer not to register.
If it were IRC, things would be different. Many IRC servers do not require registration nor acceptance of any TOS, and that *is* open to all and everyone with an internet connection. It's also a chat, allowing for many of the things that Kitrinx has mentioned.
